A legal disclaimer
1) Legally Binding Agreement
By signing a contract with Pure Paint Florida LLC, you are entering into a legally binding agreement for work to be completed at an agreed-upon price. In the event that you break this contract, all deposits made to the company shall be surrendered as damages.
2) Warranties
2a) Product Warranties:
All warranties are limited to those offered by the manufacturers of the products used. Pure Paint Florida LLC makes no additional product warranties. If you ever have a concern regarding our work, Pure Paint Florida LLC should be notified immediately.
2b) Labor Warranties:
All warranties are limited and do not cover negligence, damage, acts of God, or improper customer care. All exterior warranties require proof of regular proper cleaning by Pure Wash Florida or Pure Paint Florida. Cleaning by any other provider will void all warranties.
Pure Paint Florida LLC warranties:
Exterior painting house labor - 5 years
Interior painting house labor - 2 years
Driveway coatings - 5 years
Paver sealing - 2 years
Roof coatings - 5 years
3) Water Usage
By signing this agreement, you agree to provide Pure Paint Florida LLC the right to use an on-site water supply as needed to complete the stated project without compensation. If an exterior water supply is required, it will be at an additional charge. It is the customer’s responsibility to ensure the water supply is on and in working order before we arrive. Additional charges will apply if water is not available.
4) Electrical Usage
By signing this agreement, you agree to provide Pure Paint Florida LLC the right to use an on-site source of electricity as needed to complete the stated project without compensation. If an exterior source is required, it will be at an additional charge.
5) Color and Tone Concerns
The properties and species of wood, aging, weather, drywall inconsistencies, prior paint types, prior proper priming of drywall, and texture issues can greatly affect the resulting color or tone of the final finish. These issues may not be detectable before painting begins and may require additional coats or preparation work, resulting in additional fees. Variances may occur on individual boards, walls, or surfaces due to these factors. Pure Paint Florida LLC and its associates attempt to represent the final finish color and tones as best as possible. While we can often provide an estimate of the overall color or tone, you must expect some variance in the final finish.
Additional Coats & Satin Paint: If additional coats are required due to color variations or coverage issues, additional fees will apply. Satin paint may result in inconsistent finishes, requiring extra coats, which will be billed accordingly.
Color Selection & Samples: Customers are allowed up to three color samples at no additional charge. Each sample visit after the first will incur a fee of $250. Additionally, each color sample beyond the initial three will be billed at $20 per color. Color selections are final. If the customer decides to repaint to cover a selected color, it will be billed at the following rate: Labor $185/hr and $85 per gallon of paint.
6) Courtesy
While Pure Paint Florida LLC is on location performing work on your property, you are responsible for keeping all children, pets, and other individuals away from the work area. Children and pets must be kept off the work surface for at least 24 hours after our work is completed for safety reasons.
7) Payments
Payments to Pure Paint Florida LLC are to be made online, by cash, or by check. Jobs exceeding $1,000 require a 50% deposit. All balances are due upon completion of the job. Any variance from this policy must be agreed upon in writing. Late charges will be immediately assessed on all unpaid balances. The customer agrees to pay any collection costs incurred by Pure Paint Florida LLC in recovering outstanding balances.
8) Scheduling
Inclement weather may affect scheduling. We try our best to keep scheduling conflicts to a minimum; however, unforeseen circumstances may affect your project start and completion dates. You will be notified of any changes.
Customer Delays: If the customer causes a delay in the project (e.g., failure to move furniture, obtain necessary approvals, or provide access to the work area), additional fees may be charged for rescheduling and idle labor time.
9) Removal & Replacement of Contents
9a) Exterior Items:
Removal and replacement of grills, deck furniture, planters, and other items are the responsibility of the homeowner. If we need to remove items, we will not be responsible for any damage, breakage, or storage issues. Additional charges may apply for removal services.
9b) Interior Items:
Removal and replacement of furniture, pictures, beds, bookshelves, TVs, A/V equipment, and other items are the responsibility of the homeowner. If we need to move items, we will not be responsible for any damage, breakage, or storage issues. Additional charges may apply for removal services.
Customer Responsibility for Interior Paint Jobs: The customer must ensure all areas scheduled for painting are ready, including but not limited to doors, trim, and ceilings. Pure Paint Florida LLC is not responsible for ensuring all required items are on-site. If additional work is requested due to missing items, extra fees will apply.
10) Change Orders
Any modifications or changes to the original scope of work must be documented in a change order and signed by both the customer and Pure Paint Florida LLC. Change orders may result in additional charges and may impact the project timeline. Pricing for changes will be determined based on labor, materials, and other factors. Payment for approved change orders must be made in full before additional work begins.
11) Damages
Pure Paint Florida LLC is not responsible for damages due to improperly installed siding, loose shingles, broken or open windows, improperly sealed doors, wood rot, defective construction, or other pre-existing conditions. In cases involving aluminum or vinyl siding, power washing may highlight previously faded areas. Pure Paint Florida LLC is not responsible for such conditions.
12) Stains
Some stains cannot be removed by power washing, including but not limited to tree sap, artillery fungus, and old paint splatters. We attempt to identify these areas before starting the project, but complete removal is not guaranteed.
13) Watertight Requirements
Your property is expected to be in good repair and watertight before work begins. This includes electrical services, receptacles, light fixtures, doors, and windows. Pure Paint Florida LLC is not responsible for damage caused by water infiltration due to pre-existing conditions.
14) Window Spotting
Windows may become water-spotted due to our services. Window cleaning is NOT included.
15) Concrete Considerations
The appearance of concrete depends on various factors, including its original curing and exposure to elements. After cleaning, imperfections may become more visible. Customers should understand that not all concrete will look uniform, even on the same driveway, patio, or walkway.
